Terms and Condition
ERX Co., Ltd. (the "Company") would like to inform you the Terms and Conditions on Account Deletion ("Terms") governs the deletion of your account and related matters.
Please read these terms carefully before submitting an account deletion request. In this regard, please note that by submitting a request to the Company to delete your account, you have read and understood this Terms carefully and you have expressed your intention to the Company. You acknowledge the need of the Company to continue retaining certain types of your personal information in accordance with the details provided to you by the Company.
After you submit the request for account deletion, the Company will verify your account in accordance with these Terms of the Company. If your account meets the account deletion conditions, the Company will notify you of the result and start the account deletion process. In the case that your account does not meet the conditions, the Company will notify you of the result and your account deletion request will be rejected. After following to meet the account deletion conditions, you can request for account deletion again.
1. Account Deletion Conditions
- Your account cannot be deleted if any of the following conditions exists:

- The amount of remaining fund or digital asset is more than the withdrawal fee and/or the amount of digital asset is more than Minimum Trading Order
- Active Orders.
You need to ensure that you have no remaining fund in your account or any digital assets in your account or any pending active orders. However, if the amount of remaining fund is less than asset withdrawal fee and/or the amount of digital asset is less than Minimum Trading Order, such amount cannot be withdrawn and will be deducted as an account deletion fee.
2. Account Deletion Procedure

Before you submit the request for account deletion, please check whether your account meets the account deletion conditions specified in clause 1 of these Terms; otherwise, your account deletion process may be rejected due to failure to fulfil the deletion conditions.

After confirming that the conditions specified in clause 1 of these Terms have been fulfilled, click Request to delete account in ERX application or send an account deletion request to happy@erx.io.
- Verification
The Company will verify your account in accordance with the account deletion conditions. The Company will review the request and might ask for additional information.
- Result of Verification
- Passed
If your account meets the account deletion conditions, the Company will notify you by email or other reasonable methods, and the Company will start the account deletion process.

- Failed
If your account does not meet the account deletion conditions, the Company will notify you of the failed conditions by email or other reasonable methods. The account deletion procedure will be rejected, and you will need to request account deletion again once the conditions have been met.
3. Permanently deleted account
- Once your account is permanently deleted, the assets and data cannot be recovered. In the case that you would like to resume your access to our services in the future, you need to open a new account.
- Please DO NOT deposit any asset into the deleted account; otherwise, you might lose the asset and it would not be retrieved.
4. Retention Period
- The Company has set up a retention period for account deletion in accordance with internal policy, industry standards, relevant laws and regulations.
- When you delete your account, your personal information which we collected for providing you the services will be deleted and cannot be recovered. However, the Company is obliged to continue to retain certain types of your personal information, including but not limited to information related to KYC process, CDD process, such as name, address, email, phone number, photo, bank account, age, occupation, job title, salary, source of income and account transactions etc. The Company will retain your information for the period as required by Anti-Money Laundering and Combating the Financing of Terrorism Laws, Digital Asset Businesses law and other relevant laws and regulations.
- The Company will continue to retain your personal information in accordance with appropriate security standards for compliance with the laws at the Company. The Company is obliged to comply with the above details only, and the Company will not use your Personal Data for any other purpose without your prior consent.
- The retention period after deleting your account will start once your account has been permanently deleted.
- After the expiration of the retention period of your personal information as required by law, the Company will delete, destroy or turn your information into non-personally identifiable information in an appropriate way.
